| Title: | Verdade e processo: a epistemologia jurídica como fator essencial de um processo penal garantista |

| Summary: | A consolidação no âmbito dos tribunais supranacionais de direitos humanos da existência de um “direito a verdade”, nos oferece uma oportunidade para uma reflexão epistemológica do sistema criminal, em especial, analisar se a estrutura do sistema processual penal possui um perfil promocional da verdade. O objetivo desta dissertação é, portanto, como base na obra de Larry Laudan (Truth, error, and the criminal law: an essay in legal epistemology) debater como as atuais estruturas normativas e práticas concernentes ao sistema de justiça criminal funcionam enquanto conjunto epistemicamente adequado, isto é, projetadas, desenvolvidas e aplicadas de maneira a permitir que o sistema como um todo conduza regularmente à formação de (embora falíveis) crenças verdadeiras sobre o mundo (seja para condenar, seja para absolver), sem olvidar dos demais valores e missões que lhe são inerentes. |
| Abstract: | The consolidation within the supranational human rights courts of the existence of a “right to the truth”, offers us an opportunity for an epistemological reflection of the criminal system, in particular, to analyze whether the structure of the criminal procedural system has a promotional profile of the truth. The objective of this dissertation is, therefore, based on the work of Larry Laudan (Truth, error, and the criminal law: an essay in legal epistemology) to debate how the current normative structures and practices concerning the criminal justice system work as an epistemically adequate set , that is, designed, developed and applied in a way that allows the system as a whole to regularly lead to the formation of (although fallible) true beliefs about the world (either to condemn or to absolve), without forgetting other values and missions that are inherent. |
