| Title: | Proteção pelo Supremo Tribunal Federal à gestante no cárcere: a necessidade de medidas estruturantes |

| Summary: | O presente estudo tem o objetivo de analisar o papel da Suprema Corte Brasileira na aplicação de medidas estruturantes às mulheres no cárcere, em especial no que se refere às gestantes. As mulheres grávidas necessitam de cuidados especiais quando submetidas à prisão, tendo em vista que sua peculiar condição física e psicológica durante a gestação. A temática é relevante em face das recentes decisões do Supremo no que tange aos direitos das grávidas encarceradas, com o intuito de preservação de seus direitos humanos. O método de pesquisa utilizado foi o do Direito Comparado, assim como se realizou uma análise bibliográfica e jurisprudencial, por meio do método dedutivo. A adoção pela Suprema Corte dos Estados Unidos de medidas estruturantes garantiu direitos constitucionais que não eram efetivados pelos agentes estatais, o que conferiu ao Poder Judiciário um protagonismo relacionados à garantia do sistema de direitos humanos. Dessa forma, questiona-se se seria viável a implementação do modelo americano no Brasil, principalmente com o intuito de conferir tratamento digno às mulheres gestantes encarceradas. |
| Abstract: | The present study has the objective of analyzing the role of the Brazilian Supreme Court in implementation of structural measures for women in prison, in particular as regards refers to pregnant women. Pregnant women need special care when subjected to arrest, taking into account their peculiar physical and psychological condition during gestation. The theme is relevant in view of the recent decisions of the Supreme Court regarding the rights of pregnant women incarcerated as purpose of preserving human rights. The research method used was Comparative Law, as well as a bibliographic analysis and jurisprudential, through the deductive method. The adoption by the Supreme Court of United States of structural measures guaranteed constitutional rights that did not were carried out by the state agents, which gave the Judiciary the protagonism on the way of guaranteeing the human rights system. In this way, it is questioned if the implementation of the American model in Brazil would be viable, mainly with the aim of conferring dignified treatment to pregnant women incarcerated. |
