| Summary: | Argumenta-se que os direitos humanos surgiram da necessidade de limitação e controle dos abusos de poder do próprio Estado. Analisa-se a evolução histórica dos direitos humanos no mundo e no Brasil, bem como discute-se o processo de constitucionalização dos direitos humanos. Relata-se que a internacionalização dos direitos humanos fez surgir um novo conceito de cidadania, o qual tem na dignidade da pessoa humana sua maior racionalidade e sentido. Ressalta-se que, a problemática atual está na necessidade de garantir-se a plena aplicabilidade das normas definidoras e a efetividade desses direitos. |
| Abstract: | It is argued that human rights came out from the necessity of the limitation and control of power abuse of the state in itself. It is analized the historic evolution of the human rights in the world and in Brazil, as well as, it is discussed the process of the constitutionalization of the human rights. It is related that the internationalization of the human rights made appear a new concept of citizenship, which has dignity of the human person in his big rationality and sense. It is pointed out the current problematic is in the necessity of guarantee the plain apllyability of the defining norms and these rights effectivily. |
