A economia solidária e o direito internacional econômico

Abstract

This research intends to analyze experiences of the so called solidary economy under the prism of the Economic International Law. The transformations that occur in the international society indicate the need to investigate the possibility of juridical adjustment of the means of production which are seen as solidary. The definitions of the Economic International Law allow us to understand how the international juridical system works, taking into consideration the economic relations. Parallel to the State and the International Organizations, traditional players of the Economic International Law at the present time, are found the international organisms, the nongovernmental organizations, the international enterprises and the transnationals which determine the structure of the world economic system. The mutations of the State, with emphases to the State-Providence, show the need to seek for solutions to crises, such as unemployment and Social welfare. The experiences of the solidary economy reveal the importance of a mean of production that escapes from the rules of the capitalist system. The solidarity finds support in Resolutions adopted by the UN General Assembly, as well as by the International Labor Organization (ILO). In the new international economic order, the solidary economy is a reasonable proposal, in face of the profound inequalities that persist among the Nations. It is fair the adoption of justness in the handling of the international rules which regulate the economic relations, so that all the peoples can partake of the welfare.
