Serviços prestados pela defensoria pública: gratuidade e possibilidade de taxação dos usuários não hipossuficientes

Abstract

The subject of this essay originated from the factual reality found in the Public Defenders; which, due to the embryonic structure, scarcity of resources and high demand cannot satisfactorily serve its typical receivers, the economically needy. The relevance of this survey comes from the increasing use of the Public Defender services by the people whom gratuity of legal assistance was not offered by the Constitution. It shows the Public Defender as an institution intrinsic to the social and democratic state model, as well as its expertise with other situations and the users covered by the immunity from payment for the use of the public service of legal assistance. Additionally, the survey identifies the hypotheses and those who should bear the burden of the service charges related to the legal service. Lastly, it brings aspects of the remunerative fees related to the service of legal assistance provided by the Public Defender and it concludes with the idiosyncrasies of the legal service fees. To do so, the deductive method was used through literature review with qualitative research components.
