Globalização e direitos trabalhistas : a cláusula social no comércio interncaional

Abstract

The general objective of this work is to investigate whether the inclusion of a social clause in international trade is an effective measure to control the practice of social dumping. The issue is relevant because, in neoliberal times, with the constant attacks on workers' rights, as evidenced by unemployment, poverty and poor working conditions, in addition to affecting the employees themselves distort international trade through the practice of social dumping. The research design of this study is linked to the research line with international law as an instrument of integration tax, economic and political. The investigation we used the inductive method, operationalized with the techniques of the referent category, the operational concept and the literature. The specific objectives are embodied in three chapters of the research: the first carries out studies on how globalization and neoliberalism can directly affect the social, the second chapter emphasizes the effects of trade liberalization with the emergence of the GATT and later WTO, for finally, the third and final chapter has targeted social dumping as a result of depletion of social rights advocated by neoliberal policies. At the conclusion will be presenting the final points highlighted in the chapters devoloped.
